Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Chengdu Archimeta Network Technology Co., Ltd. ("Company," "we," "us," or "our"), the developer and operator of the mobile game Zombie Balls: Path of Escape (the "Game"), available on Google Play (Android) and in the future on the Apple App Store (iOS). By downloading, accessing, or playing the Game, you agree to be bound by these Terms and our Privacy Policy (available at: https://www.archimetanet.com/privacy.html). If you do not agree, do not download or use the Game.

1. Who May Use the Game

1.1 Age requirement. You must be at least 13 years old (or the minimum age of digital consent in your country, e.g., 16 in much of the EEA/UK) to use the Game. The Game is also subject to the content rating and age restrictions applied by the distribution platform (Google Play or the Apple App Store), and you must be at least the minimum age indicated by that rating. If you are under the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

1.2 Not directed to children. The Game is not directed to children under 13. We do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will delete it. Parents who believe their child has provided us personal information may contact us at contact@archimetagame.com.

1.3 Accounts. You may play the Game as a guest, or sign in with Google Play Games. If you create or link an account, you must provide accurate and complete information and keep it up to date. You are responsible for all activity on your account and for keeping your Google account credentials confidential. Guest accounts are local to your device and may not be recoverable if you change devices, reinstall the Game, or if test data is reset (see Section 4).

2. License; Restrictions

2.1 License. Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download, install, and use the Game for your personal, non-commercial entertainment purposes on devices you own or control.

2.3 Platform terms. Your use of Google Play or the Apple App Store is also governed by their respective terms (Google Play Terms of Service; Apple Media Services Terms). These Terms do not limit your rights under those platform terms with respect to the platform itself.

3. Virtual Items, Currency, and Purchases

3.1 Virtual currency and items. The Game may include virtual currency, items, features, or content ("Virtual Items") that you may acquire through gameplay or by purchase via Google Play Billing or Apple In-App Purchase. Virtual Items:

3.2 Purchases. All purchases of Virtual Items are processed by Google or Apple through their billing systems. We do not collect or store your payment card details. Payment-related matters (including refunds requested through the store) are handled under Google Play's or Apple's refund policies; you may contact us at contact@archimetagame.com for Game-related purchase issues and we will assist where we can.

3.3 No refunds except as required by law. All purchases are final and non-refundable, except where required by applicable consumer law, Google Play policies, or Apple App Store policies. Nothing in these Terms limits statutory consumer rights you may have under the laws of your country of residence (including EU/UK consumer protection law and applicable Southeast Asian consumer protection law).

3.4 Price changes and service changes. We may change prices, adjust the Game economy, balance Virtual Items, or discontinue features. Where required by law, we will give advance notice of material changes.

3.5 Discontinuation of the Game. We may discontinue the Game. If we do, we will provide notice where reasonably practicable. Upon discontinuation, access to the Game and to any unused Virtual Items ends, and we will not provide refunds for unused Virtual Items except as required by applicable law or by the policies of the relevant app store.

4. Pre-Release, Beta, and Test Versions; Data Reset

4.1 Test Versions. From time to time we may offer pre-release, alpha, beta, soft-launch, closed test, or other test versions or testing periods of the Game ("Test Versions"). Test Versions are provided for evaluation and testing purposes, may be unstable or incomplete, may contain bugs, may have limited availability, and may be modified, suspended, or discontinued at any time.

4.2 Paid features during testing. We may enable paid features, including in-app purchases, in a Test Version. Where we do so:

We may reset, wipe, or delete test accounts, game progress, and Virtual Items at any time, including at the end of a testing period, without liability, provided that we have made the disclosure described in Section 4.2(a). Where reasonably practicable, we will provide advance notice of a scheduled reset (for example, in the Game or by email).

4.4 Refunds or compensation for test purchases. Where real-money purchases were made in a Test Version and the related data is reset or the Test Version is discontinued, we will, at our discretion and/or as required by applicable law or the policies of the relevant app store, provide a refund or equivalent compensation for unused paid Virtual Items. Requests may be sent to contact@archimetagame.com and must include your player ID and order/transaction details.

4.5 No liability for test data loss. To the maximum extent permitted by applicable law, and subject to Section 4.4, we are not liable for any loss of progress, Virtual Items, achievements, or accounts arising from testing, resets, technical failures, or discontinuation of a Test Version.

5. Your Conduct

You agree not to, and not to attempt to:

6. User Content

6.1 If the Game lets you submit content (e.g., usernames, in-game chat, guild names, replays, feedback), you retain ownership of your content, but you grant us a worldwide, perpetual, irrevocable, royalty-free, transferable, sublicensable license to host, use, reproduce, adapt, publish, and display it for the purpose of operating, promoting, and improving the Game.

6.2 You represent that you have all rights needed to submit your content and that it does not violate these Terms or any law. Do not include sensitive personal information in player names or chat.

7. Advertising and Third-Party Services

The Game integrates third-party services, including: Google Firebase (Analytics, Crashlytics, and backend hosting), Google AdMob (advertising), AppsFlyer (install and campaign attribution), Google Play Games (sign-in and game services), Alibaba Cloud (backend hosting), and Discord (community and player support). Those services are governed by their own terms and privacy policies; we are not responsible for third-party services. 8. Availability, Updates, and Termination

8.1 Availability. The Game is provided on an "as available" basis. We may update, modify, suspend, or discontinue the Game (or any feature) at any time, with notice of material changes where feasible. Continuing to use the Game after an update means you accept the updated Terms.

8.2 Termination by you. You may stop using the Game at any time by uninstalling it and, if applicable, requesting account deletion at contact@archimetagame.com.

8.3 Termination by us. We may suspend or terminate your access to the Game if you violate these Terms, if required by law, if we discontinue the Game, or as part of a test data reset under Section 4. Upon termination: (a) your license ends; (b) Virtual Items are forfeited without refund except where required by law or by Section 4.4; (c) sections that by their nature should survive (including Sections 3, 4, 6, 7, 9, 10, 11) survive.

9. Disclaimers

THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR COMPATIBLE WITH YOUR DEVICE. NO ORAL OR WRITTEN ADVICE OBTAINED FROM US CREATES ANY WARRANTY. Some jurisdictions do not allow limitations on implied warranties, so the above may not fully apply to you.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) WE AND OUR AFFILIATES, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE GAME; AND (b) OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE TOTAL AMOUNTS YOU PAID US FOR VIRTUAL ITEMS IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IF YOU MADE NO PURCHASES IN THAT PERIOD, OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED USD 50.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded or limited under applicable law — including statutory consumer rights under EU/UK law and the consumer protection laws of your country of residence.

11. Indemnity

You will defend, indemnify, and hold harmless the Company and its affiliates from any third-party claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Game, your User Content, or your violation of these Terms or applicable law.

12. Consumer Rights Notice (EEA / UK / Southeast Asia)

If you are a consumer in the EEA, UK, or a Southeast Asian jurisdiction, you have statutory rights that these Terms cannot limit, including rights relating to defective digital content, refunds where digital content is faulty, and access to your local consumer protection and dispute resolution bodies. For EU consumers, the EU Online Dispute Resolution platform is available at https://ec.europa.eu/consumers/odr.

Withdrawal right (EEA/UK consumers): where you purchase digital content (including Virtual Items) supplied by download or in-app delivery, you acknowledge that supply begins immediately upon delivery of the content and you consent to immediate performance; you therefore lose your statutory right of withdrawal once the content has been delivered and performance has begun.

13. Governing Law and Disputes

13.1 Governing law. These Terms are governed by the laws of the People's Republic of China, without regard to conflict-of-law rules.

13.2 Informal resolution first. Before filing a claim, please contact us at contact@archimetagame.com — most issues can be resolved quickly.

13.3 Disputes. Any dispute that cannot be resolved informally will be submitted to the competent courts located in Chengdu, Sichuan Province, People's Republic of China, except that: (a) if you are a consumer in the EEA or UK, you may also bring claims in your country of residence, and nothing in these Terms prevents you from bringing claims in your local small claims or consumer forum where permitted; and (b) either party may bring claims in a jurisdiction where mandatory local law provides otherwise.

14. General

14.1 Changes to these Terms. We may update these Terms. We will notify you of material changes in the Game or via other reasonable means at least 14 days before they take effect where required by law. Continued use after the effective date means acceptance.

14.2 Severability. If any provision is held unenforceable, the rest remains in full force, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

14.3 Assignment. You may not assign these Terms. We may assign them (e.g., in connection with an acquisition) with notice.

14.4 Entire agreement. These Terms, together with the Privacy Policy and any in-game purchase or test terms shown at the point of sale, are the entire agreement between you and us regarding the Game.

14.5 Language. These Terms may be translated for convenience. In the event of a conflict, the English version prevails.
